01Acceptance of these terms
These Terms of Use (“Terms”) govern your access to and use of talentsscout.com (the “Site”) and any information or tools provided through it, operated by TalentsScout (“TalentsScout”, “we”, “us”). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
Our Privacy Policy explains how we handle personal information and forms part of these Terms.
02About our services
TalentsScout provides recruitment and hiring, performance management, payroll administration, and training and development services. Information on the Site is provided for general information only and describes our services at a high level.
Services delivered to employers or other clients are governed by a separate written agreement. If there is a conflict between these Terms and a signed client agreement, the client agreement prevails for the services it covers.
03No guarantee of employment or placement
We work to connect talented people with suitable opportunities, but we do not guarantee that any candidate will be offered an interview, placed in a role, or hired, nor that any employer will find a suitable candidate. Employment decisions are made by employers, and any employment relationship is between the candidate and the employer, not TalentsScout, unless we state otherwise in writing.
04Using the Site
You agree to use the Site lawfully and respectfully. You must not:
- submit false, misleading or fraudulent information, including false CVs, credentials or identity details;
- submit another person’s information without their authority;
- attempt to gain unauthorised access to the Site, our systems or other users’ data;
- introduce viruses, malware or other harmful code;
- scrape, copy or harvest data from the Site by automated means without our written permission;
- use the Site to send spam or unsolicited promotions, or to interfere with its normal operation.
05Information you submit
When you send us a CV, application or enquiry, you confirm that the information is accurate and that you have the right to provide it. You give us permission to use it to provide our services as described in the Privacy Policy, including sharing candidate information with employers for roles you have agreed to be considered for.
Employers and other businesses agree to submit vacancy and employee information only where they are entitled to do so, and to handle any candidate information they receive from us lawfully and only for the purpose of assessing the relevant candidate.
06Intellectual property
The Site and its content, including text, design, graphics, logos and the TalentsScout name, are owned by or licensed to us and protected by intellectual property laws. You may view and print pages for your own personal or internal business use. You may not copy, reproduce, modify, distribute or commercially exploit any part of the Site without our prior written consent.
07Third-party links
The Site may link to websites operated by others. We do not control and are not responsible for their content, policies or practices. Visiting them is at your own risk.
08Disclaimers
The Site and its content are provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including about accuracy, completeness, availability or fitness for a particular purpose. Content on the Site is general in nature and is not legal, tax or employment advice. You should seek professional advice for your specific circumstances.
09Limitation of liability
To the fullest extent permitted by law, TalentsScout and its directors, employees and partners will not be liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, data or opportunity, arising from your use of, or inability to use, the Site. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for fraud or for death or personal injury caused by negligence.
10Your responsibility
You agree to be responsible for, and to compensate us for, any loss or claim arising from your breach of these Terms or your misuse of the Site, to the extent permitted by law.
11Governing law
These Terms are governed by the laws of India, and the courts of Patna, Bihar have exclusive jurisdiction over any dispute arising from them, except where local consumer or data protection law gives you the right to bring a claim elsewhere.
12Changes to the Site and these Terms
We may change, suspend or discontinue any part of the Site at any time, and we may update these Terms from time to time. The “Last updated” date shows the latest version. By continuing to use the Site after changes are posted, you accept the updated Terms.
